Terms & Conditions

§ 1 Application of General Terms and Conditions
The general terms and conditions define the relationship between Dynamic Equilibrium and its clients, unless it has been agreed otherwise in written form.

§ 2 Conclusion and termination of contract
A contract is binding following to an appointment by phone or in writing (letter, fax, email). Should an appointment be made via e-mail , this appointment is considered binding, even though the appointment has not been reconfirmed by the client in a separate mail.

Dynamic Equilibrium is allowed to terminate the contract without providing any reason. This also applies in case the client’s ailments or symptoms do not fall into the scope of kinesiology according to legal regulations.

Dynamic Equilibrium is equally allowed to terminate a contract without providing any reason, if the confidential relation between Dynamic Equilibrium and its client has been disturbed or cannot be maintained any longer.

Dynamic Equilibrium is entitled to its fees for all services rendered until the day the contract has been terminated.

§ 3 Subject of the contract
The client uses the services provided within the scope of standard methods of kinesiology.

The client and Dynamic Equilibrium define the purpose and the goal of the kinesiology session. This session aims to energetically activate the client’s personal development process by using standard methods of kinesiology.

Kinesiology is not a medical science and is not a replacement for any medical or psychotherapeutic treatment. From the standpoint of academic medicine, kinesiology is unsuitable for diagnostics. In case of health problems or illness consultation and treatment should be obtained from a medical doctor, homeopathic practitioner or psychotherapist.

A session in kinesiology such as provided by Dynamic Equilibrium requires preparation and thorough follow-up by means of protocols and reports. In some cases a digital recording of a session is recommended. In this case, a written approval is requested from the client upfront.

§ 4 Result of a session
The cooperation is based on preliminary discussions between the client and Dynamic Equilibrium. It is based on mutual trust.

A session in kinesiology is a free, active and autonomous process where specific results and successes cannot be guaranteed. Dynamic Equilibrium provides support and guidance during this process by means of kinesiology. The client’s cooperation is essential to the outcome of this process.

§ 5 Fees & Expenses
Fees fall due promptly against presentation of invoice following to the appointment. The fee rate is agreed by the client prior to the appointment. The fee is payable in cash unless agreed otherwise.

Travel charges of CHF 80.- per hour are applied for sessions rendered outside the location of Rotkreuz (ZG).

§ 6 Cancellation and Fees
Cancellation of an appointment is free of charge up to 24 hours prior to the agreed date and time. Appointments set on a Monday can be cancelled free of charge latest by Friday 12.00 midday. For cancellations beyond that time, the full fee is applied and payable.

§ 7 Duration of a session
A session takes about 60 – 90 minutes but may take longer in certain cases.

§ 8 Confidentiality
Dynamic Equilibrium undertakes to treat any information that relates to the client’s personal and business life as strictly confidential. The confidentiality prevails beyond the contractual period.

§ 9 Health condition
The client confirms that he/she does not suffer from any disease causing a lack of capacity to contract or which contraindicates methods of kinesiology due to medical, psychiatric or psychological reasons. Should the client be in doubt about his health condition, he /she undertakes to consult a doctor, homeopathic practitioner or psychotherapist.

Should a disease be diagnosed, the client undertakes to inform Dynamic Equilibrium promptly. If need be, sessions in kinesiology may be postponed or terminated, unless the treating doctor approves the continuation of the sessions.

§ 10 Final Clause
Additional agreements must be in written form. Should some paragraphs or The General Terms and Conditions be invalid, they shall be replaced by legally valid terms which correspond closely with the meaning of the invalid ones.
